Subsequent purchasers necessary in specific performance suit, HC sets aside trial court order

Before The High Court Of Karnataka - In a specific performance suit of sale agreement, the high court held that subsequent purchasers of the property are the necessary parties and must be impleaded to ensure an effective decree. The trial court order upon rejecting the application to add those purchasers as defendants was set aside. The high court directed the trial court to expedite and conclude the suit within a year, emphasizing that the subsequent purchasers can be affected by outcome and are hence, essential to the proceedings.
